The Constitution of India - Article 226 - The Right of Children to Free and Compulsory Education Act, 2009 - The Kerala Right of Children to Free and Compulsory Education Rules, 2011 - A  writ petition for enforcing contract of personal service is not maintainable against the school discharging a public duty.  

Judicial review in policy matter which is wisdom of the policy, cannot be judicially scrutinised, though the Court can consider whether the policy is arbitrary or violative of law.

Constitution of India -  Art. 21A -  Right of Children to Free and Compulsory Education Act, 2009 -  S.16 -  Prohibition of holding back and expulsion -  Right to education up to the age of 14 years is guaranteed as fundamental right - a student cannot be failed up to 8 th  Class.
